Thank you Blackburne for coming out to vote at the AGM December 5th and taking interest in our community! We would first of all like to thank our outgoing board members: Nathan Maslanko, Brian Hawrelak, Drew Schofield, Marilyn Rude and Dan Edwards for their service and commitment of countless volunteer hours to our community. As we move forward, it is so important that community members continue to share their gifts and talents with our neighbourhood to make this a community we can take pride and comfort in.
Your new board members elected through Secret Ballot are: Chris Benoit, Cathy Newton, Lowry Fortner, Jeff Wagner, Amit Lonkar, Brad Friesen, Dan Yip, and Michelle Kuefler. Clayton Hillyard was also elected but has since resigned. We have a lot to learn as we take on our new roles and will begin working with the Property Management Company to make this transition as seamless as possible. Please note that Helm was signed by the previous board to a one year contract.
The new board has many questions as there was a lot of new information shared at the AGM. It will take some time to better understand the current situation with respect to the management company, trust fund, legal counsel and current financial situation. We know we may not all agree about the best way forward but hope that as we seek answers to these questions that we can heal and find a resolution as a community. We thank you for your patience and grace.
Seeking clarity through the legal system on the interpretation of the restrictive covenant will be important. This will ensure the board has clarity on the approvals & enforcement passed along to the HOA as there are differing legal opinions. This will not be an easy task and will take time.
While our community is waiting for this clarity, the current board IS required to enforce the restrictive covenant. Nothing has changed with the voting of new board members in this respect. The HOA's lawyer reviewed this at the AGM and it is consistent with information shared by other lawyers in the past. Please also remember that any member who has the RC on their land title can also enforce this through the courts. We all need to wait for clarity before we proceed. We would hate for anyone to replace their roof with a non-wood roofing product, remove their brick work or make changes to other items included in the restrictive covenant before we have clarity from the legal system. If you are aware of friends or neighbours that are planning to rush ahead please encourage them to wait.
